August 2012&lt;\/p&gt;\n&lt;p&gt;Das Bundesgericht hat entschieden, dass Lego-Bausteine auch in der Schweiz nicht als dreidimensionale Formmarken gesch\u00fctzt werden k\u00f6nnen. Das Gericht hat eine Beschwerde gegen ein gleichlautendes Urteil des Handelsgerichts Z\u00fcrich abgewiesen. Zum gleichen Ergebnis kam vor rund zwei Jahren auch der Europ\u00e4ische Gerichtshof. Das Handelsgericht hatte die Formmarken bereits im Jahr 2002 f\u00fcr nichtig erkl\u00e4rt. Nach einer Zur\u00fcckweisung durch das Bundesgericht und weiteren, umfangreichen Abkl\u00e4rungen best\u00e4tigte es dieses Urteil im Jahr 2011. Das Bundesgericht sch\u00fctzte die Ausf\u00fchrungen des Handelsgerichts, wonach die Form der Bausteine technisch notwendig und deshalb vom Markenschutz ausgeschlossen sei. Alle gepr\u00fcften Alternativen seien mit h\u00f6heren Herstellungskosten verbunden. Die Form der Lego-Bausteine sei deshalb nicht markenschutzf\u00e4hig.&lt;\/p&gt;\n&lt;p&gt;Beginn des Rechtsstreits vor \u00fcber 12 Jahren&lt;\/p&gt;\n&lt;p&gt;Mit seinem Urteil (4A_20\/2012 vom 3. Juli 2012) schliesst das Bundesgericht einen \u00fcber zw\u00f6lf Jahre dauernden Rechtsstreit ab. Im Jahr 2000 hatte die Mega Brands Inc., eine kanadische Konkurrentin der LEGO System A\/S (nachfolgend: Lego), gegen diese geklagt und vom Handelsgericht Z\u00fcrich gefordert, dass f\u00fcnf der von Lego eingetragenen dreidimensionalen Marken f\u00fcr nichtig erkl\u00e4rt werden. Es handelte sich dabei um die Formarken Nr. 411469, 433265, 433266, 433267 und 433268. Das Handelsgericht hiess diese Klage im Jahr 2002 erstmals gut. Lego zog dieses Urteil danach weiter ans Bundesgericht, welches die Beschwerde teilweise guthiess und zur weiteren Sachverhaltsabkl\u00e4rung an das Handelsgericht zur\u00fcckwies (vgl. Urteil 4C.46\/2003, publiziert als BGE 129 III 514). Es forderte das Handelsgericht insbesondere auf, abzukl\u00e4ren, ob die von Lego beanspruchten Formen technisch notwendig sind (Art. 2 lit. b MSchG) sind. W\u00fcrde dies zutreffen, w\u00e4ren sie markenrechtlich nicht schutzf\u00e4hig.&lt;\/p&gt;\n&lt;p&gt;Umfangreiche Abkl\u00e4rungen notwendig&lt;\/p&gt;\n&lt;p&gt;Der Grund f\u00fcr die lange Dauer des Verfahrens ist, dass umfangreiche Abkl\u00e4rungen notwendig waren. Das Handelsgericht forderte Lego auf, gleichwertige Alternativformen zur eingetragenen Form zu pr\u00e4sentieren. Im Oktober 2004 schliesslich pr\u00e4sentierte Lego 50 Alternativformen. Diese wurden anschliessend von einer Expertengruppe begutachtet. Diese mussten jede Alternative auf ihre Funktionsf\u00e4higkeit und die entstehenden Kosten pr\u00fcfen. Die Experten legten dem Gericht schliesslich im Mai 2010 ihr Gutachten vor. Gest\u00fctzt auf dieses und die Stellungnahmen der Parteien dazu hiess das Handelsgericht am die Klage 23. November 2011 erneut gut.&lt;\/p&gt;\n&lt;p&gt;Bereits geringer Kostennachteil ist unzumutbar&lt;\/p&gt;\n&lt;p&gt;Das Handelsgericht kam zum Schluss, dass sich alle Alternativformen sowohl anf\u00e4nglich als auch \u00fcber die gesamte Lebensdauer betrachtet als teurer erwiesen. Damit scheiterten s\u00e4mtliche Alternativformen am Kostenkriterium. Aus diesem Grund seien die registrierten Formen als technisch notwendig zu betrachten, was zur Nichtigerkl\u00e4rung der Marken f\u00fchrte.&lt;\/p&gt;\n&lt;p&gt;Lego erhob auch diesmal Beschwerde gegen das Urteil. Sie begr\u00fcndete diese insbesondere damit, dass die Mehrkosten f\u00fcr die Alternativformen nicht bedeutend genug seien, um die registrierten Formmarken als technisch notwendig im Sinne von Art. 2 lit. b MSchG erscheinen zu lassen. Das Bundesgericht wiederholte darauf die Idee hinter dieser Vorschrift: Da das Markenrecht dem Markeninhaber eine zeitlich unbegrenzte Monopolstellung einr\u00e4umt, soll diese nur dann erm\u00f6glicht werden, wenn den Mitbewerbern dadurch angesichts gleichwertiger Alternativen kein Nachteil entsteht. Es hielt weiter fest, dass daraus folgend bereits ein geringer Kostennachteil von alternativen Formen f\u00fcr die Mitbewerber unzumutbar sei. Es sei auch in F\u00e4llen von geringen Kostenunterschieden davon auszugehen, dass diese geeignet sind, sich auf den Wettbewerb auszuwirken.&lt;\/p&gt;\n&lt;p&gt;Fazit: Lego-Bausteine k\u00f6nnen nicht als Formmarken eingetragen werden&lt;\/p&gt;\n&lt;p&gt;Weiter warf Lego dem Handelsgericht willk\u00fcrliche Beweisw\u00fcrdigung und eine Verletzung des rechtlichen Geh\u00f6rs vor. Insbesondere seien die Berechnungen der Experten falsch, da sie auf unrealistisch engen Toleranzen und falschen Pr\u00e4missen basieren w\u00fcrden. Das Bundesgericht wies auch diese R\u00fcgen ab und kam zum Schluss, dass die von den Lego-Marken beanspruchten Formen aufgrund der h\u00f6heren Herstellungskosten f\u00fcr Alternativformen als technisch notwendig (im Sinne von Art. 2 lit. b MSchG zu betrachten sind und wies die Beschwerde vollumf\u00e4nglich ab.&lt;\/p&gt;\n&lt;p&gt;Urteil des EuGH aus dem Jahr 2010&lt;\/p&gt;\n&lt;p&gt;Bereits vor rund zwei Jahren entschied der Europ\u00e4ische Gerichtshof (EuGH) einen Rechtsstreit zwischen denselben Parteien gleich und sprach den Gemeischaftsmarken von Lego den Schutz ab (vgl. BR-News vom 7. Oktober 2010). Der EuGH liess damals jedoch offen, ob die Nachahmung der Lego-Bausteine allenfalls \u00fcber das Recht des unlauteren Wettbewerbs verboten werden k\u00f6nnte. Dies war im konkreten Fall nicht Gegenstand des Verfahrens. In der Tat w\u00e4re auch in der Schweiz ein lauterkeitsrechtliches Vorgehen denkbar (vgl. Art. 3 Abs. 1 lit. d i.V.m. Art. 9 UWG). So really this is not a LEGO hand at all &#8211; it may be designed after their outdated lapsed patent based design idea, but it is mechanically different in the way it works, and for that it has steel Yellow Hand (download STL below): as it is, stainless steel can be 3D printed but it is not quite as cheap as PLA &#8211; but then, it does not break nearly as fast.<\/p>\n<ul>\n<li>I cannot advise to use Shapeways, as their metal prints are <em>really crap<\/em>, quality wise, but if you try the services of <a href=\"https:\/\/www.materialise.com\/en\" target=\"_blank\" rel=\"noopener noreferrer\">materialise<\/a>, you may get better instances.\u00a0 I got the 3D-print from Shapeways and whereas the PLA model here was a perfect fit for my wrist adapter, as were the measurements inside the 3D software, I had to grind down the clearly oversized Shapeways metal 3D-print model.
